The use of this website and the registration of an order through it is considered as agreement with the stated terms and conditions. If you DO NOT ACCEPT these terms, please do not use this website. Sport Depot JSC reserves the right to change the terms at any time, without prior notice, and the changed terms will be published on the website.

1. General Terms

„www.absolute-teamsport.bg“ is an e-commerce website for the sale and delivery of goods published on it, on behalf of Sport Depot JSC.

• The publication of this website constitutes a public invitation to conclude a commercial transaction for the purchase of online items from Sport Depot JSC.
• Sport Depot JSC through „www.absolute-teamsport.bg“ has the right to change the prices of offered goods at its own discretion, without prior notice. The User is required to pay the price that was valid at the time of the order of the desired goods. Price reduction notices are made by placing the new price below the old one, with the latter being crossed out.
• There may be differences in the prices of some items offered on the website and in the Sport Depot store network, which are due to local activities and discounts.
• If an incorrect or wrong address, contact person and/or phone number is provided when submitting an order, Sport Depot JSC through „www.absolute-teamsport.bg“ is not bound by any obligation to fulfill the order.
• The contract with the Customer is considered concluded after acceptance by Sport Depot JSC through „www.absolute-teamsport.bg“ of the purchase request correctly completed by the Customer in the ordering process.
• Sport Depot JSC through „www.absolute-teamsport.bg“ undertakes, upon receipt of a request from the Customer, to deliver the desired product or to inform the Customer of other circumstances regarding his order.
• Sport Depot JSC is not responsible if the Customer has provided incorrect and/or incomplete information in an order placed at „www.absolute-teamsport.bg“.
• Sport Depot JSC does not guarantee full compliance with the items presented on the site and those available in the store network.
• Sport Depot JSC is not responsible for any inaccuracies in the information published on the website. Price corrections in stores are possible, as well as changes in product design.
• The dimension and match/size information published on the website should be interpreted as indicative. Sport Depot JSC acknowledges the possibility of discrepancies between the stated and actual sizes, for which it assumes no responsibility.
• The categorization of articles by purpose („Sport“ filter) is exemplary.
• All announced prices are in euros with VAT included.

Seasonal discounts in Sport Depot in summer resort stores begin on August 27, and in winter resort stores on February 27.

2. Rights and Obligations of Parties

2.1. Sport Depot JSC undertakes:

• to confirm the availability of ordered articles or to reject the order within 7 business days;
• to deliver the goods within the period specified in the "Information on Delivery section"*.

• each item is checked for technical condition before shipment (if possible, without compromising the package integrity);
• guarantees that all products are brand new (unused!) and sealed by the manufacturer, except in cases where the contrary is explicitly mentioned in the presentation of the goods on the website.

2.2. The Customer undertakes:

• to provide their full name, valid phone number, delivery address, and email address;
• to pay the price of the goods according to the conditions described in the "Information on Delivery and Payment" section;
• to pay the delivery costs according to the conditions described in the "Information on Delivery and Payment" section;
• to provide access and conditions for receiving the goods.

The ordered goods are delivered to the delivery address specified by the Customer, within the timeframe indicated in the "Information on Delivery and Payment" section.

The goods are delivered appropriately packaged, according to their type and the mode of transport for delivery.

Upon delivery of the goods, the Customer or a third party signs the accompanying documents. A third party is considered anyone who is not the person who placed the order, but accepts the goods upon delivery and is present at the address specified by the Customer. During seasonal sales, it is possible for the order to be delivered in multiple shipments.

If the Customer is not found at the specified address within the delivery timeframe, or if access and conditions for handing over the goods are not provided within this period, SPORT DEPOT JSC is released from its obligation to deliver the ordered goods. The Customer may confirm their desire to receive the goods even after the expiration of the delivery period during which they were not found at the address, bearing all delivery costs. In this case, a new delivery period begins from the moment of confirmation.

2.3. The Customer has the right to refuse receipt of the ordered goods if they are delivered under any of the following conditions:

• the delivered goods clearly do not correspond to the goods ordered for purchase by the Customer and this can be determined through ordinary inspection;
• the price that the Customer is to pay does not correspond to the price due;
• in case of discrepancy between the goods ordered for purchase and the goods delivered, which could not be established at the time of delivery.

In case of a discrepancy between the ordered and delivered goods, the Customer has the right to request a replacement of the size or item included in their original order. In this case, it is necessary to state this request in writing (via email) or verbally (by phone) within a period of no more than 30 days to the following address: Sofia 1766, 6 Vasil Radoslavov Str., Business Park Sofia, SPORT DEPOT building, Online store.

The Customer has the right, within a period of no more than 30 days, without owing compensation or a penalty and without stating a reason, to return the received items to the following address: Sofia 1766, 6 Vasil Radoslavov Str., Business Park Sofia, SPORT DEPOT building, Online store.

SPORT DEPOT refunds all amounts received from the consumer, including delivery costs.

The costs of returning the goods at the expense of SPORT DEPOT when using Speedy or Econt.

2.3.1. Returns are allowed under the following conditions:

• the request to return the goods is submitted in writing to the email address for correspondence provided by SPORT DEPOT JSC, within a period of no more than 30 days, starting from the date of receipt of the order. The request must contain the customer's personal bank account to which the amount paid for the goods will be refunded;
• the goods are in good commercial condition, in their original packaging, with original labels, accompanied by the original documents issued by SPORT DEPOT JSC – invoice, receipt, warranty card (if one was issued);
• the customer agrees with a representative of SPORT DEPOT JSC on the address where SPORT DEPOT JSC wishes to receive the returned goods;
• in accordance with the provisions of the Consumer Protection Act (CPA), SPORT DEPOT refunds the paid amount to the customer within 14 days from the date on which the customer exercised their right to return the goods.

SPORT DEPOT JSC reserves the right not to refund the amount paid by the customer in case of violation of one or more conditions for the return of goods.

2.3.2. Refunding amounts paid by cash on delivery.

When refunding amounts paid by cash on delivery, there must be an identity match between the person who ordered the goods and the person returning the goods, regardless of who received them. The person who ordered and returned the goods will receive back the money paid by cash on delivery. If the ordering party is a child, the money is returned to the child's account or to their legal representative - mother, father, or guardian. For this purpose, it is necessary to present a Birth Certificate or a Decision for the appointment of a guardian.

2.3.3. Refunding amounts paid partially or entirely with a gift voucher.

• When the order is paid entirely with an online gift voucher, the amount for the returned product(s) is refunded in the form of an online voucher for the website.
• When the order is paid partially with an online gift voucher, depending on the number of returned items and the additional amount paid, the following options are possible:
  • If the value of the voucher is equal to or exceeds the value of the returned product(s), the amount is refunded in the form of an online voucher.
  • If the value of the used voucher is less than the value of the returned product(s), the value of the voucher is refunded in the form of an online voucher, and the additional amount paid is refunded according to the payment method of the order:
    • In case of additional payment for the order with a debit/credit card, the additionally paid amount for the return is refunded to the payment method used for the transaction. If additional bank account details are needed, they will be requested from you.
    • In case of additional payment for the order in cash, the additionally paid amount for the return can be refunded to a bank account specified by you in your name or via postal money order.
• In case of additional payment by cash on delivery or card, the amount can be entirely refunded in the form of a voucher, upon the explicit request of the customer.

3. Personal Data

SPORT DEPOT JSC respects the privacy of its customers and guarantees the maximum protection of their personal data. For more information, please read our Privacy and Personal Data Protection Policy. It is prepared and based on the applicable Bulgarian and European legislation in the field of personal data protection.

SPORT DEPOT JSC, through "www.absolute-teamsport.bg", exercises due diligence to protect the Customer's personal data, which become known when filling out the electronic form for registration on the website and making a purchase. This obligation is waived if the Customer has provided false information.

Subject to applicable law, the clauses of these General Terms and Conditions and the Privacy Policy, SPORT DEPOT JSC may use the Customer's personal data solely and exclusively for the purposes for which they were provided.

4. Revealing the information

SPORT DEPOT JSC, through "www.absolute-teamsport.bg" is obliged not to reveal any personal data about the Customer to third parties – government authorities, commercial companies, individuals, and others, except when:

• it has received the explicit written consent of the Customer;
• the information is requested by state authorities or officials who, according to current legislation, are authorized to request and collect such information;
• SPORT DEPOT JSC, through "www.absolute-teamsport.bg", is obliged to provide the information by law.

5. Liability

SPORT DEPOT JSC, through "www.absolute-teamsport.bg", is not liable for failure to fulfill its obligations under this contract upon the occurrence of circumstances that SPORT DEPOT JSC, through "www.absolute-teamsport.bg", did not foresee and was not obliged to foresee – including, but not limited to, cases of force majeure, fortuitous events, problems in the global Internet network and in the provision of services beyond the control of SPORT DEPOT JSC through "www.absolute-teamsport.bg".

6. Arbitration

All disputes between the parties shall be resolved in a spirit of understanding and goodwill. In the event that no agreement is reached, all unresolved disputes arising from or relating to the contract between the parties, including disputes arising from or relating to its interpretation, invalidity, execution, or termination, as well as disputes for filling gaps in the contract or adapting it to newly arisen circumstances, shall be resolved by the competent court of registration of SPORT DEPOT JSC in accordance with Bulgarian legislation.

7. Warranty Conditions

SPORT DEPOT JSC provides its customers with a warranty card for every purchased product with a warranty, which states:

• address and telephone number of the authorized service centers for the purchased equipment;
• warranty conditions of the respective service centers or manufacturers;
• warranty period of the purchased goods;

Except for the obligations specifically stated in this warranty, SPORT DEPOT JSC cannot be held liable for direct, indirect, special, incidental, or consequential damages, whether based on contract, tort, negligence, or any other legal theory, and regardless of whether the possibility of such damages was anticipated.

For all products, the warranty conditions of the respective manufacturer or authorized service centers apply. Only the original warranty cards with which the goods were received are valid in the service centers.

8. Warranty Limitations

The warranty is void in the event of:

• Damage caused by poor transportation, storage, or improper use.
• Attempted repair by the Customer and/or another unauthorized person.
• Use of low-quality and non-original consumables.

9. Additional Conditions

SPORT DEPOT JSC is not liable for damage to the goods due to force majeure circumstances.
